Upon uploading your images to Pixretouch online photo retouching service it signifies your agreement with all terms & conditions listed below.

1, You agree to have read all terms & conditions and your usage of Pixretouch indicates your acceptance of all terms & conditions. The right to use Pixretouch is based on compliance to all terms & conditions set forth in this agreement.

2, by submitting images to Pixretouch this authorizes Pixretouch to work on the images. You certify that you hold the copyright or have the written permission from the photographer to manipulate the photo. By submitting photos to Pixretouch you affirm no copyright is infringed. We will not be liable to you or any third party for such copyright infringement.

3, you may not upload images or any type of content that you do not have the lawful right to or any type of content that you do not have the lawful right to and is obscene, harmful, hateful, threatening, defamatory, pornographic, deceptive, or any type of placement or transmission of any tpe of material using this site that is obscene including viruses or computer code designed to disrupt or destroy computer software or equipment, any software that monitors site architecture and invades privacy of users, any automatic or manual process to harvest information from this site such as unsolicited emails, phone calls, deceptive emails, fax transmissions using company headers or any misrepresentation or misconduct governed by provincial or federal law.

4, all elements of this site including graphics, design, compilation and other matters related to the site are protected under applicable copyrights, trademarks and other proprietary rights (including and not limited to intellectual property rights) The copying, redistribution, use or publication of any parts of the site is strictly prohibited. You do not gain ownership rights to any content or document of this site being viewed.

5, Pixretouch reserves the right to turn down images that it believes to be inappropriate or illegal in nature. In such an event Pixretouch will refund the full amount paid by the client.

6, your privacy is very important to Pixretouch. Pixretouch does not share or sell personal information with any other third parties. All information provided will be handled in a highly confidential manner. We collect and store your name and email address only for the purpose of completing your order and providing to you retouching service. Your image file(s) will be stored on our computer systems approx. two weeks after order completion and will not be deleted until we know all retouching has been completed successfully.

7, Pixretouch reserves the right to reject any images that it believes cannot be retouched to the customer's satisfaction.
 

8, Pixretouch is not responsible for final end user utilization of the retouched images and any damages that you might make in its use.

9, if you feel the retouched images do not meet your requirements it is up to you to send the necessary changes within seven working days after receiving the final image.Pixretouch will work on the image to meet your satisfaction only one single time.
 Any other corrections will be subject to an estimate of the fees applicable to obtain the result expected by you.

10, Pixretouch reserves the right to terminate any person from the website with or without cause. Pixretouch will report any misconduct to the authorities and will prosecute unlawful conduct to the fullest extent of the law. Pixretouch reserves the right to use all resources including IP addresses, customer identifying data to investigate and report abuse of this website.
 

11, Payment will be made at PayPal at the time of the order being placed. We offer secure payment through PayPal. All orders must be paid in full before the work is done.
 

12, you agree that Pixretouch will not be responsible for any liability or loss or damages or expenses including legal fees related to the use of our website or the violation of this agreement. We have no liability whatsoever for your use of any information or service on this site. No communication with Pixretouch whether oral or written shall create any warranty or guarantee. As the user you will understand that upload and download with Pixretouch is done at your own risk and you will be responsible for any loss or damage to your picture. All files will be carefully checked for viruses in the unlikely event a file contains a virus Pixretouch will not be liable or responsible for any possible damages incurred. Also if there is a disruption in Pixretouch service in which the service in unavailable or if any performance of service is delayed Pixretouch will have no liability whatsoever. The products and services provided by Pixretouch are "as is" with "all defects" and all warranties express or implied are disclaimed.
 

13, we reserve the right and for you to authorize us to the use and assignment of all information regarding site usage consistent with our privacy policy. All communication of any type will forever be our property without limitation we will have exclusive ownership of all present and future existing rights to the submission of any kind. We will be entitled to use the submission for any commercial or other purpose whatsoever without compensation to you or any other person sending the submission. You acknowledge that you are responsible for whatever material or communication you submit including its copyright, legality and appropriateness.
 

14, Turn around times do not imply a guarantee. Times will be determined by workload and you will be notified approximate times ahead of time. We do our best to meet the 72 hours turn around .
 

15, Pricing is subject to change without notice. Once an order is placed the price will be honored for that particular order. If a special takes place during this process no credit will be given.
 

Last, This agreement will be treated as though it were executed in California. Thus governed in accordance with CA provincial and federal law of US. Should any part of this agreement be held unenforceable that part will be ruled by applicable law and the remaining parts of the agreement shall remain in full effect. Our rights of this agreement shall survive any termination of this agreement.
